2020
The paper deals with the impact of the first ruling of the Constitutional Court on glorification of terrorism (112/2016) in the interpretation of this offence by the Supreme Court, which demands hermeneutically requirements absent from the literality of art. 578 of the Criminal Code and that the Constitutional Court required in its previous case law on hate speech, recently reiterated in the ruling 35/2020 of the Constitutional Court. Firstly, the text addresses the initial description of the elements of this criminal figure by the Supreme Court and its characterization as public defence without incitement, as opposed to the definition of the crime of public provocation to terrorism in the …
2018
The essay is about limits imposed to the legislature to enact retroactive statute law in “civil matters”. It tackles the dichotomy existing between the European Court of Human Rights’ and the Italian Constitutional Court’s jurisprudence on the theme. The first one has repeatedly ruled that the legislature is not prevented from regulating, through new retrospective provisions, rights derived from the laws in force. Nevertheless, the principle of the rule of law and the notion of a fair trial enshrined in Article 6 of the European Convention of Human Rights preclude, except for compelling public-interest reasons, interference by the legislature with the administration of justice designed to i…
2023
The article deals with the notion of personal freedom as it is regulated by art. 13 of Italian Constitution, drawing the main differences with other fundamental rights, in particular with the freedom of movement (art. 16 Cost.). To this end, the paper explores the main doctrinal orientations and the most recent constitutional case-law on the subject; specifically, it proposes a reading of the motivational points of the judgment n. 127 of 2022 of the Italian Constitutional Court which resolved some touchy issues of constitutionality that arose during the pandemic emergency. In conclusion, the text questions, with a look at the near future, on the usability of traditional tools for the protec…

Informal Constitutional Changes in Romania
2015
Constitutional change has been one of the most interesting debates in the recent constitutional law scholarship. A distinction has been drawn between formal and informal constitutional changes, by using as a criterion the compliance with the requirements of the constitutional text regarding constitutional change. Usually, informal constitutional change is determined by various factors, among which the lack of clarity or the extreme rigidity of the Constitution. Constitutional Courts are among the authorities who are frequently responsible of making informal constitutional changes. The present article comprises a brief introduction on the differences between formal and informal constitutiona…
2020
The Italian Constitutional Court has been asked to decide on a constitutional incidental question referred to it by the Antitrust Authority. Rejecting the thesis of a quasi-judicial nature of the functions exercised by the Agcm and denying the existence of "gray areas" of constitutional justice, the the judgment no.13/2019 takes a position on the institutional placement of the Authorities within the administration. This, in addition to offering elements for reflections on the constitutional model of reference, requires important legal repercussions in terms of the effectiveness of the constitutional protection of connsidered interests.
2019
In two judgments delivered in 2018 (No. 120 and No. 194), the Constitutional Court for the first time referred to provisions of the European Social Charter as an interposed norm in the constitutional review of primary laws. The two judgments, however, leave two questions open. First, in judgment No. 120, the Court recognizes taht the European Social Charter may complement Article 117, paragraph 1, of the Constitution, as it constitutes a natural integration of the European Conventionof Human Rights on the social level, which in fact distinguishes it from "ordinary" international agreements. In its subsequent judgment No. 194, on the other hand, the Court speaks of treaties with constitution…
